Section 117
Cancellation of Insurer
(1) Notwithstanding anything contained in existing law, no insurer shall be rescinded.
(2) If an insurer wants to be liquidated/decided by the general meeting, an application must be submitted to the authority along with the action plan for voluntary liquidation.
(3) If an insurer's application is received in accordance with sub-section (2), the authority shall carry out necessary investigations and such insurer shall fulfill its obligations in full. If he is satisfied that he is able to pay, he may give permission to the insurer to proceed with the proceedings for rescission, subject to the necessary conditions.
